Longstanding legal case finally resolved by the B.C. Supreme Court.
Vancouver (4 Jan. 2010) - The corporate owner of the Vancouver Sun and The Province newspapers has lost a four-year battle to publish advertisements over the objection of unionized employees involved in a labour dispute.
The dispute centred on a decision by the Communications, Energy and Paperworkers Union (CEP) to refuse to allow Telus ads in newspapers during a 2005 Telus strike.
The ban was rescinded by the union before 2005 had ended but the company continued its case and a series of legal rulings have followed since that time by the courts and the B.C. Labour Relations Board (BCLRB).
The latest, by B.C. Supreme Court Justice Elaine Adair, refused to overturn a ruling by a BCLRB 'reconsideration panel' upholding the union's "hot edict" against Telus ads. She said the panel had not been "patently unreasonable" in its finding – a legal test that must be met to quash BCLRB decisions.
